BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the Chattanooga Public Schools Lake Property and the United States Army Property adjacent thereto described in that certain Sale and Purchase Agreement dated January 25, 1995, and amended January 19, 1996, be and are hereby declared surplus, which property is more fully described as follows: Being the City of Chattanooga (City Board of Education) Property described in Deed Book 1562, Page 95, recorded in the Register's Office of Hamilton County, and being known as Parcel 6, PERIMETER AREAS VOLUNTEER ORDNANCE WORKS, formerly of the Simeon Colley Tract, being more particularly described as follows: To find the true beginning, begin at the Western right- of-way of Webb/Turkeyfoot Road and the Northeastern corner of the Parks property described in Deed Book 1227, Page 518, thence North 63 degrees 08' 00" West a distance of 413.02 feet to the true point of beginning, being US-TVA Monument 150-3, thence along said property and a portion of the United States of America property described in Deed Book 853, Page 567, South 21 degrees 22' 00" West a distance of 192.0 feet to the Northeasternmost corner of Lot 84, Bal Harbor S/D, Unit 3, recorded in Plat Book 33, Page 119, thence along the Northern line of Lots 84, 83, 81, 80 and 79 of said Bal Harbor S/D South 63 degrees 04' 26" West a distance of 535.25 feet (South 62 degrees 55' 00" West, 535 feet Deed) to an iron pin found, thence North 72 degrees 49' 00" West a distance of 535.65 feet (545 feet deed) to a TVA marker at the 690 contour, thence along the 690 contour in a North and Northeasterly direction a distance of 500 feet (more or less) to the Northwestern corner of the property, excepted from by Deed Book 1562, Page 95, thence along the Western line of said property South 20 degrees 33' 00" West a distance of 275.34 feet (280.2 feet deed), thence along the Southern line of said property North 69 degrees 12' 02" East a distance of 448.95 feet (North 69 degrees 30' 00" East, 451.2 feet deed), thence along the Eastern line of property North 00 degrees 01' 31" East a distance of 189.60 feet North 01 degrees 18' East Deed), thence North 35 degrees 15' 28" West a distance of 160.12 feet (North 35 degrees 51' West, 160.2 feet deed) to a angle iron found at the 690 contour, thence along the 690 contour in a Southeasterly and Northeasterly direction a distance of 1360 feet (more or less) to a point, thence leaving said 690 contour South 25 degrees 00' East a distance of 5.0 feet to a point on the Western right-of-way of Webb/Turkeyfoot Road, thence in a Southerly direction along said right-of-way with a curve to the left an arc length of 949.36 feet (said curve having a radius of 512.558 feet) to a point on the Parks property, thence along said Parks Northern line North 63 degrees 08' 00" West a distance of 413.02 feet (388 feet deed) to the point of beginning. BE IT FURTHER RESOLVED, That the sale of said property to R & D, Inc. be and is hereby authorized in accordance with the terms of the Sale and Purchase Agreement dated January 25, 1995, as amended on January 19, 1996.
